The CCJ to hear its first case next Monday

BRIDGETOWN, Barbados: Barbados is already set to be the first country to take a criminal matter to the Caribbean Court of Justice, but it will now also be the first with a civil case set for next Monday at the court’s headquarters in Port-of-Spain, Trinidad.

The CCJ judges are expected to hear the appeal in which Barbados Rediffusion Service Limited is challenging a decision of the Court of Appeal of Barbados involving Asha Mirchandani, Ram Mirchandani and McDonald Farms Ltd. 

The matter stems from the July 28th and August 4th, 1989 airing of live broadcasts of the semi-finals and finals of the Pic-o-de-Crop Calypso Competition, on radio stations owned by Barbados Rediffusion. Mrs. Mirchandani alleged that she and her company, McDonald Farms Limited, were libelled during the live broadcasts. 

In 1999, Mirchandani et al obtained judgment with damages to be assessed and the radio station company had its defence struck out for failing to comply with an order of the Chief Justice delivered on February 20, 1995. This decision was confirmed by the Court of Appeal on August 20, 2004.
